Terms of Service

General

BeHighflyer.com welcomes you. As BeHighflyer.com grows, we may update this Terms of Service statement to reflect changes, to comply with applicable regulations and self-regulatory standards or otherwise. We reserve the right to make changes to these Terms at any time. Any such modifications will become effective immediately upon posting to the site and your continued use of the site, Services and/or Software constitutes your agreement to such modifications. You agree to regularly review the current version of these Terms as posted on the site.

BeHighflyer.com reserves the right to change prices without advance notice and to offer promotions periodically to certain group of users and thus not available to all users. Any changes to prices will become effective immediately upon posting to the site. You agree to regularly review the current version of the prices as posted on the site.

For Parents and Students

  1. Booked appointments can be rescheduled provided the same tutor has other available timeslots. Rescheduling must be done 48 hours before the original appointment commences. In the event that a student missed a lesson or was late for a lesson, there is no refund.
  2. You are not allowed to post any contact information on the site or during the chatting session to recruit, solicit, or contact in any form tutors for employment. For students found doing that, we reserve the right to suspend or terminate your account(s) and refuse any and all current or future use of the Services, or any portion thereof. Moreover, a charge of SGD 200 will be imposed.
  3. BeHighflyer.com does not evaluate or guarantee the accuracy of any solutions presented by a tutor during an online tuition session. Nevertheless, we are confident about the quality of our tutors.
  4. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we believe that such information is untrue, inaccurate, not current or incomplete, we reserve the right to suspend or terminate your account(s) and refuse any and all current or future use of the Services, or any portion thereof.
  5. You must always make sure your contact email in our records is updated. That’s the only channel we send you confirmation of your registration, details of booked appointment, reset password instructions, updates on our services, etc.
  6. You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You may choose to share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to BeHighflyer.com.

For Tutors

  1. You must be a current/ex-school teacher, graduate, undergraduate (from Nanyang Technological University (NTU), National University of Singapore (NUS), Singapore Management University (SMU) and Singapore Institute of Management (SIM)), or a fulltime tutor currently residing in Singapore. You must have a minimum academic qualification of A’ level certificate and good grades in the subjects that you wish to teach.
  2. Registration is free of charge. A 20% commission will be deducted from the tutor for every 1 hour of online tutoring session with a student. The pricing stated on this site is BEFORE deduction. See Pricings.
  3. The tuition fees for the sessions that you had conducted for a particular month, after deduction of 20%, will be paid to you on the 20th of that month and the 5th of the following month.
    For sessions conducted between 1st and 15th inclusive of a particular month, will be credited to your account on the 20th of that month. For example, if you had conducted a session on the 10th January 2008, you will receive the fees on the 20th January 2008.
    For sessions conducted between 16th and 31st inclusive of a particular month, will be credited to your account on the 5th of the following month. For example, if you had conducted a session on the 28th January 2008, you will receive the fees on the 5th February 2008.
    Note: If 5th and 20th falls on a sunday/public holiday, you will receive the fees on the next working day.
  4. You are responsible for keeping track of the completed sessions or refer to Archive sessions on your login page. Tuition fees will be transferred to the bank account stated on your registration form. You are again reminded to be responsible for maintaining the confidentiality of your BeHighflyer.com account and password and for restricting access to your computer.
  5. BeHighflyer.com will contact you within 24 hours to verify all your particulars. We will have to ensure that your qualifications and experience meet the minimum standards.
  6. Tutors are not allowed to post any contact information on the site or during the chatting session to recruit, solicit, or contact in any form students for employment. For tutors found doing that, we reserve the right to suspend or terminate your account(s) and refuse any and all current or future use of the Services, or any portion thereof. Moreover, a charge of SGD 200 will be imposed.
  7. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we believe that such information is untrue, inaccurate, not current or incomplete, we reserve the right to suspend or terminate your account(s) and refuse any and all current or future use of the Services, or any portion thereof.
  8. You must always make sure your contact email in our records is updated. That’s the only channel we send you confirmation and verification of your registration, details/changes of booked appointment, reset password instructions, updates on our services, etc.
  9. It is the tutors' responsibility to check their emails regularly and turn up for appointments punctually. In the event that a tutor was late for an appointment or missed an appointment, an administrative charge of SGD 150 will be imposed.
  10. It is the tutors' responsibility to be prepared for their appointment. Before the start of the appointment, Tutors are reminded to read up or work out a solution, for the questions posted by the student.
  11. You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You may choose to share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to Highflyer.com.
  12. If you find that you're a victim of identity theft and it involves BeHighflyer.com account, you should notify us at . Then, you should report this instance to all your credit card issuers, as well as your local law enforcement agency. BeHighflyer.com reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect itself and its partners from what it believes to be fraudulent activity. Highflyer.com is not obligated to credit or discount a membership for holds placed on the account by either a representative of BeHighflyer.com or by the automated processes of BeHighflyer.com.

Disclaimer

  1. BeHighflyer.com will not act as an arbitrator or mediator for any conflicts or disagreements that arise between the tutor and the student.
  2. You understand that all information, such as data, text, photographs, graphics, messages, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not BeHighflyer.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. BeHighflyer.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will Highflyer.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
  3. Any materials, information, communications or ideas that you upload, communicate or otherwise transmit or post to us, the site, the Tutors or the Services by any means ("User Content") will be treated as non-confidential and non-proprietary, and may be disseminated or used by us for any purpose whatsoever, including, but not limited to, quality control and professional development, as well as our developing, manufacturing, and marketing our current and/or future Services. By uploading or otherwise making available any User Content, you automatically grant and/or warrant that the owner has granted to us the perpetual royalty-free, non-exclusive, world wide right and license to use, reproduce, modify, publish, distribute, perform, display, and transmit the User Content for any purpose. We reserve the right to review the Tutoring Sessions for any purpose. Notwithstanding anything to the contrary above, you agree that we own all transcripts of Tutoring Sessions and all comments that you may provide to us on or through the site, the Services any other means as a part of user satisfaction or other similar surveys, and that that these Terms shall be deemed an irrevocable assignment of all such transcripts and comments, each portion thereof and all intellectual property rights therein to us.
  4. You may download and print a reasonable number of copies of documentation provided or available in connection with the Company Content for noncommercial personal or educational use only and we grant you a limited, non-perpetual, revocable, nontransferable, non-assignable, non-exclusive, royalty-free license to access and utilize the Services, the Software and the other Company Content for noncommercial personal or educational purposes while these Terms are in full force and effect; provided that (i) any permitted copies of documentation provided or available in connection with the Company Content contain, in an unmodified form, (a) all language designations contained in the materials originally provided to you by us indicating the confidential nature thereof.
  5. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.
  6. You agree to not use the Service to:
    1. upload, email, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
    2. harm minors in any way;
    3. impersonate any person or entity, including, but not limited to, a BeHighflyer.com official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
    4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
    5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
    6. upload, email, post, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
    7. upload, email, post, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    8. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
    9. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
    10. intentionally or unintentionally violate any applicable local, state, national or international law, and any regulations having the force of law;
    11. "stalk" or otherwise harass another; and/or
    12. collect or store personal data about other users in connection with the prohibited conduct and activities as stated in paragraphs i through xi above.

You acknowledge that BeHighflyer.com may or may not pre-screen Content, but that BeHighflyer.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, BeHighflyer.com and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by BeHighflyer.com or submitted to BeHighflyer.com. You acknowledge, consent and agree that BeHighflyer.com may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of BeHighflyer.com, its users and the public. You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You understand that the Service and software embodied within the Service may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by BeHighflyer.com and/or content providers who provide content to the Service. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

SPECIAL ADMONITIONS FOR INTERNATIONAL USE

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the sharing of technical data and personal information exported from the country in which you reside.

CONTRIBUTIONS TO HIGHFLYER.COM

By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to BeHighflyer.com through its suggestion or feedback web pages, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) BeHighflyer.com is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) BeHighflyer.com shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) BeHighflyer.com may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of BeHighflyer.com without any obligation of BeHighflyer.com to you; and (f) you are not entitled to any compensation or reimbursement of any kind from BeHighflyer.com under any circumstances.

You agree to indemnify and hold Highflyer.com and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

MODIFICATIONS TO SERVICE

BeHighflyer.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that BeHighflyer.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

TERMINATION

You agree that BeHighflyer.com may, under certain circumstances and without prior notice, immediately terminate your Highflyer.com account, any associated email address, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your BeHighflyer.com account includes (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in BeHighflyer.com's sole discretion and that Highflyer.com shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.

DEALINGS WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that BeHighflyer.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because BeHighflyer.com has no control over such sites and resources, you acknowledge and agree that BeHighflyer.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that BeHighflyer.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICE. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BeHighflyer.com AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BeHighflyer.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

GENERAL INFORMATION

Entire Agreement. The TOS constitutes the entire agreement between you and Highflyer.com and governs your use of the Service, superseding any prior agreements between you and Highflyer.com with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other BeHighflyer.com services, affiliate services, third-party content or third-party software. Choice of Law and Forum. The TOS and the relationship between you and BeHighflyer.com shall be governed by the laws of Singapore without regard to its conflict of law provisions. You and BeHighflyer.com agree to submit to the personal and exclusive jurisdiction of the courts located within the country. Waiver and Severability of Terms. The failure of BeHighflyer.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. No Right of Survivorship and Non-Transferability. You agree that your BeHighflyer.com account is non-transferable and any rights to your BeHighflyer.com ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted. Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
